Private and in the top of a hill right beside the ocean. pool, beach, river, beautiful views all around, BBQ, pizza oven and full furnished house There are no many places were you can be right beside the ocean beach and have a house 15 meters above sea level with 270 degree view of ocean, river and green vegetation. The house has 4 bedrooms and 4 bathrooms, with an open to the ocean kitchen, living room, dining room and over/BBQ area. Great view form everywhere! Spectacular balconies to enjoy the ocean and river view. Great decks to do yoga. oven to bake your own pizza or bread, large BBQ, Pool with outstanding view of the ocean. Pleasant breeze of the river or ocean wind. Live surrounded by nature, with the singing of the birds and the sound of the ocean. Friendly fisherman’s town just 10 minutes away. The house has in-house keepers; their duty is to keep the place clean and the pool always ready. Please be informed that the finishing of the interior of the house are not new, but they are clean and sound. The last mile of access to the house is an unpaved road and in rainy season a four wheel drive is recommended. This road keeps the privacy of the area. The closes town –Casares- have small grocery stores, two restaurants, fisherman fresh market, farmacies, bakery, churches of various denominations and, other small shops. Local fisherman like to drink but are not offensive, there is no crime risk in this small town where everybody knows each other. The closes large city is Diriamba, 30 minutes driving, where you can find hospitals and much larger retail stores and services. From Casares, there are buses to/from Diriamba everyday for a very reasonable cost. Potable water is service by the town, the house has its own reservoirs. In dry season water may have limited supply. Caretakers available 24/7 Quiet place, close to fisherman town but far enough to be private and quiet. 14 minutes walking distance to Casares town. Important. Prices shown are based on 2 adults + kids less than 8 years old do not pay. Additional adult will cost you additional $18 to $25 dollars per night depending on season (could be paid at check in). please contact us for details. RESIDENTIAL LEASE AGREEMENT THIS LEASE (the “Lease”) dated as per the payment received, BETWEEN: The legal owner of the residence in lease (the “Landlord”) AND the person making the payment for the lease (the “Tenant”) (individually the “Party” and collectively the “Parties”) IN CONSIDERATION OF the Landlord leasing certain premises to the Tenant and other valuable consideration, the receipt and sufficiency of which consideration is hereby acknowledged, the Parties agree as follows: Leased Property 1. The Landlord agrees to rent to the Tenant the house “Balconies to Paradise” (the Property), for use as residential premises only. 2. Subject to the provisions of this Lease, apart from the Tenant, no other persons will occupy of visit the property for any extend of time without the prior written permission of the Landlord. 3. The Tenant is not allow to bring any other person other than the reported in the payment process. 4. No animals are allowed to be kept in or about the Property. 5. Parking space is provided as a complementary service without any warranty, service or insurance and it is under the vehicle owner own responsibility. 6. The Tenant and members of Tenant’s household will no smoke anywhere in the Property nor permit any guests or visitors to smoke in the Property. 7. The Tenant and members of Tenant’s household will not vape anywhere in the Property nor permit any guests of visitors to vape in the property. 8. The use of any pleasure Drug of any type is absolutely ban in the Property 9. Alcoholic beverages are permitted in a moderate quantity that in anyway may allow the Tenant or the Tenant’s household to act impair. 10. The Tenant will pay the rent prior to accessing the premises. 11. A damage deposit no lower of $100 USD will be collected prior to accessing the premises. This deposit will be used to compensate any damage to the property or worn doing. Cost of damage amount will be calculated and defined by the Landlord or the Landlord representatives only. 12. No nudity or acts of promiscuity are allowed in the Property. Rent 13. The rent will commence at 2 pm and end at 11 am unless a written authorization is obtained prior to accessing the Property. 14. The Tenant will pay the Rent before getting access to the Property 15. The payment received will define the extent of this Lease agreement. 16. The Landlord will not be able to increase the rent price during the period already paid in advance Inspections 17. The Parties will complete, sign and date an inspection report at the beginning and at the end of this tenancy. 18. The Landlord or their representative reserve the right to inspect the property during the Tenancy agreement to clean, maintain, confirm its good use, supervise that the term of the lease are being respected. 19. The Tenant will obtain written permission form the Landlord before ding any of the following: - applying adhesive materials, or inserting nails or hooks in walls or ceilings - painting, wallpapering, redecorating or in any way significantly altering the appearance of the Property. - installing a waterbed - changing the amount of heat of power normally used on the property or installing additional air conditioning, coolers or ventilators. -placing or exposing or allowing to be placed or exposed anywhere inside or outside the Property any placard, notice, sign for advertising or any other purpose; or - affixing to or erecting upon or near the Property any antenna or tower. Insurance 20. The Tenant is hereby advised and understands that the personal property of the Tenant is not insured by the Landlord for either damage or loss, and the Landlord assumes no liability for any such loss. 21. The Tenant is not responsible for insuring the Landlord’s contents and furnishings in or about the Property for either damage or loss, and the Tenant assumes no liability for any such loss. Attorney Fees 22. In the event that any action is filed in relation to this Lease, the unsuccessful Party in the action will pay to the successful Party, in addition to all the sums that either Party may be called on to pay, a reasonable sum for the successful Party’s attorney fees. Governing Law 23. This Lease will be construed in accordance with and exclusively governed by the laws of the Province of British Columbia. Severability 24. If there is a conflict between any provisions of this Lease and the Act, the Lease will prevail. 25. The invalidity or unenforceablility of any provisions of this Lease will not affect the validity or enforceability of any other provision of this Lease. Such other provisions remain in full force and effect. Amendment and Subletting 26. Without the prior, express, and written consent of the Landlord, the Tenant will no assign this Lease, or sublet or grant any concession or licence to use the Property or any part of the Property. A consent by Landlord to one assignment, subletting, concession, or licence will not be deemed to be a consent to any subsequent assignment, subletting, concession, or licence. Any assignment, subletting, concession, or licence without the prior written consent of Landlord, or an assignment or subletting by operation of law, will be void and will, at Landlord’s option, terminate this lease. Damage to Property 27. If the Property get damaged in anyway during the Tenant occupancy the Landlord reserve the right to deduct a reasonable cost from the deposit to replace any damage part of item. Cost will be calculated as the price of a new piece or new construction. Care and use of Property 28. The Tenant will not engage in any illegal trade or activity on or about the Property 29. The Parties will comply with standards of health, sanitation, fire, housing and safety as required by law. 30. The Parties will use reasonable efforts to maintain the Property clean and garbage in place 31. After the return from the beach it is mandatory to wash & remove all sand before returning to the house and washrooms. A shower and a food faucet are furnished on the exterior of the house for this purpose. Mediation 32. If any dispute relating to this Lease between the Parties is not resolved through informal discussion within 14 days from the date a dispute arises, the Parties agree to submit the issue before a mediator. The cost of any mediation will shared equally by the Parties. General Provisions 36. All monetary amounts stated or referred to in this Lease are based in United States Dollars. 37. Where there is more than one Tenant executing this Lease, all Tenants are jointly and severally liable for each other’s acts, omissions and liabilities pursuant to this Lease. 39. The Tenant will be charged and additional amount of $25.00 USD for each N.S.F. check or checks returned by the Tenant’s financial institution. 40. If the Tenant leaves the Property ahead of time or at anytime after the ingress to the Property, the full rent levy will be charged to the Tenant. 41. This Lease constitutes the entire agreement between the Parties 42. The payment of the Lease cost and the acceptance of payment represents the acceptance of all the items in this document. 43. It is ban any type of weapon in the property. 44. The Owner reserves the right to cancel any reservation or lease if this agreement is breached in anyway.
