Enjoy the sounds of waterfalls (Front and Back of house), hiking, fishing and other family-friendly activities close by, great views. Bear Footin is a great getawayfor couples, solo adventurers, and families (with kids). Home is fully furnished, and beautifully landscaped. Home has wilderness setting on 1.5 private acres. Beautiful back yard deck overlooks stream with waterfall. At night, lights overlook falls and stream where you can sometimes view wild trout. Open window or screen door and hear the sound of the waterfall throughout the home. Enjoy your morning cup of coffee on the covered front porch overlooking the pond and a second waterfall. An enclosed Gazebo with swing also sits next to the pond. The home is very spacious with high ceilings. It has a large Master bedroom and two other nice size bedrooms. A large living room, dining room and eat in kitchen with a table and large bar overlooking pond! All bed linens and towels provided. Fully equipped kitchen including dishes and cooking utensils. Home has a two TVs with Roku channel options. The home borders a national park which has several streams and waterfalls within walking distance. Within a few miles is Upper Whitewater Falls which is the highest waterfall east of the Rockies. The falls plunge an amazing 411 feet!This is an extremely desirable area in North Carolina, close to Cashiers & Highlands. Brevard is a 30-minute drive and Asheville is an hour and 15 minutes away. Area is famous for the many waterfalls in the surrounding regions. Great summer and winter recreation close by, including skiing, hiking, fishing, horseback riding, white water rafting, etc. Home has laundry facilities Entire Home We border Gorges State Park. Lot's of hiking trails to visit Waterfalls no public transportation. A vehicle is required. These Terms and Conditions apply to anyone renting the property at 351 Meadowlark Lane , Sapphire NC. (Phone number hidden by Airbnb) All renters must be accompanied by an adult over the age of 25. TERMS AND CONDITIONS The Rental Deposit (50% of the Rental Fee) is due upon confirmation of booking request. Submitting a booking request is contingent upon acceptance of these terms and conditions. This fee includes a $350 security fee. Upon arrival the $350 converts to a damage deposit. see below for information on security/damage deposit. RATES: Rates are quoted on a per night, per week or per month basis as noted. Unless specified, check-in time is after 5:00 p.m., and checkout by 11:00 a.m. on the day of departure. Security/Damage Deposit: A security deposit of $350 is required to hold your reservation. Upon arrival the $350 converts to a damage deposit . If the following provisions are met, your deposit will be refunded within 14 days of your departure. • no damage done to the home or its contents • no linens or household items are missing • No signs of smoking in the home • no early check-in or check-out unless approved by agent CHECK IN AND CHECK OUT TIMES Check-in is at 5:00 pm | Check-out time is at 11:00 am. Unless otherwise arranged with Agent, the 11:00am check-out time is crucial for the cleaning contractor to perform housekeeping duties. Therefore, please note that unauthorized late check-outs will be subject to a $ (Phone number hidden by Airbnb) charge in the event the contractor’s cleaning crew cannot enter the vacation rental premises. RESERVATIONS AND PAYMENTS: Payment of the applicable 50% Rental Deposit amount must be received by (Hidden by Airbnb) before a confirmation will be issued. No grace period will apply. Final payment, consisting of the remaining balance, must be received at least thirty (30) days prior to guest arrival (or immediately if booked less than thirty (30) days in advance of guest arrival). Failure to make final payment on time will result in cancellation of reservation and forfeiting deposit. This rule supersedes the cancellation policy documented below. CANCELLATIONS: Travelers who cancel at least 60 days before check-in will get back 100% of the amount paid. If you are eligible for a refund, (Hidden by Airbnb) handles all refunds. CONDITION OF RENTAL: The property shall be in the same condition upon departure as at check-in. Normal wear and tear excepted. Owner or its agents may enter the property at reasonable times to make repairs. Guest may cook in areas specifically designated for cooking. Guest must immediately notify Owner or agent of fire or other damage to property. Guest shall be liable for all acts of the family, invitees, employees, or other persons invited onto the property. Guest may not sublet or assign this rental agreement. Guest shall abide by the House Rules of the Owner, Property Manager, Condominium Association and/or the Booking Agent as provided to Guest. Guests shall not bring any pets onto the property. Guests will not smoke indoors. PET POLICY Failure to comply with the No Pets policy will result in additional charges to cover cost of cleaning furniture and carpeting. and may result in eviction from the property. Trash Policy Following good trash etiquette is critical ALL trash must be put into trash bags prior to putting into outdoor bins. Failure to comply with this policy will result in $25.00 charge. Liability / Waiver Agreement: 1. I am aware that my stay at the Property involves risks that may result in serious bodily injury and/or death. Some of the risks include, but are not limited to, drowning, slips, trips, falls, cuts, adverse weather conditions, the acts or omissions of guests or visitors on the Property during my stay, and the condition of the Property. I understand that the description of the risks in this Release of Liability, Waiver of Claims and Assumption of Risk (the “Document”) is not complete and that other risks or events that are known or unknown, anticipated or unanticipated may result in serious bodily injury and or/death. 2. In consideration of being permitted to rent and stay at the Property, I agree on my own behalf and on behalf of my family and guests and on behalf of my children and all minors in my care, custody or control (hereafter also included in “I” or “my”) to assume full responsibility for the risks identified herein and those risks not specifically identified. I hereby release from liability and waive any and all claims that I have or may have in the future against any employees, and representatives (collectively “Releasees”) as well as the landlord/owner of the Property. 3. I understand and acknowledge that being in or near the ponds/rivers/water can present various risks and hazards, including strong currents, unexpected activity, floating debris and other potential hazards. I assume all such risks associated with being near or in the water. 4. I agree to fully and forever release and discharge, and not to sue Releasees for any injuries or damages, including property damage that may result from arise out of or be related in any way to my rental and stay at the Property. If any portion of this Document shall be declared unenforceable for any reason, the unenforceable portion shall be considered severed from the Document and the remainder of the Document shall not be affected and shall be valid and enforceable to the fullest extent permitted by law. 5. By signing this waiver, I assume all risk, and take full responsibility and waive any claims of personal injury, death or damage to personal property associated with activities and events during or related to the stay in the subject property. I ACKNOWLEDGE THAT I HAVE READ THIS ENTIRE DOCUMENT AND THAT I UNDERSTAND ITS TERMS AND AGREE TO BE BOUND BY THEM. I UNDERSTAND THAT THE EFFECT OF THIS DOCUMENT IS THAT I AM RELEASING LIABILITY AND WAIVING MY RIGHT TO SUE RELEASEES AND I AM ASSUMING RISK FOR MATTERS RESULTING FROM, ARISING OUT OF OR RELATING IN ANY WAY TO MY RENTAL AND STAY AT THE PROPERTY, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, DEATH AND PROPERTY DAMAGE. I ACKNOWLEDGE THAT THIS DOCUMENT APPLIES EVEN IF RELEASEES MAY BE NEGLIGENT IN WHOLE OR PART. I UNDERSTAND THAT THIS DOCUMENT APPLIES TO AND SHALL BE EFFECTIVE AND BINDING UPON ME, MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVE, ESTATE, AND ALL MEMBERS OF MY FAMILY, MINORS, AND OTHERS IN MY CARE, CUSTODY OR CONTROL.
